<p> Referring to the previous explanation, it is important to conduct research that develops a jurisprudential inquiry-based learning strategy. This strategy leads the students to think systematically and critically in terms of responding to issues related to fiqh happening at schools or in society (Horsley, 2010; Nava-Aguirre et al., 2019). This strategy suits the demands of learning fiqh that require students to think logically and systematically in solving fiqh problems. Students can state their opinions on what they think best to do as a solution to a case. Students are allowed to make decisions by applying the learning strategy, focusing on their thinking ability, that in the end, they come up with the best decision. It is then conducted a study aiming at developing the jurisprudential inquiry-based learning strategy titled The Development of Jurisprudential Inquiry-Based Learning Strategy at Madrasah Tsanawiyah Koto Tuo.</p>

<div> Legalizing alcoholic beverages under Indonesian Presidential Decree Number 10 of 2021 concerning to Investment Business raises conflicting view with Islamic norms in Indonesian as religious state. Under Islamic norm such prohibition intended to maintaining of reason (ḥifẓ al-ʿaql), while on the one hand it is for the improvement of the country’s economy (ḥifẓ al-mal). This paper measures such contradictory under maqasid Syariah auspice. The method used is a normative research with a content analysis approach. This paper found that the legalization of investment in alcoholic beverages has not reached to the stage of necessity (ḍaruriyya), while the acquisition of property (ḥifẓ al-mal) was obtained through the legalization of alcoholic beverage investments, only at the level of (taḥsiniyyah). Therefore, something related to the tahsiniya level should not negate the position of ḍaruriyya of ḥifẓ al-ʿaql. Eliminating the potential of greater mafsadah must be put forward by the Indonesian government rather than producing uncertain maslahah. </div> <div> </div>

<p> This study describes the domination of local custom and religion behind the tradition of Osong Kapali among Sungai Patai community in Tanah Datar, Minangkabau, Indonesia during the decease of Datuak (the leader of ethnic group). It employs a qualitative method with observation, interviews, and documentation as research instruments. It revealed, for people, that the majesty of datuak is reflected on not only the time he receive the tittle but also the time he passes away. This ceremony is intended to honor the dead datuak. The tradition begins with baretong (planning), mangkaji adaik (discussing the tradition), mancabiak kain kafan (tearing the shroud), osong kapali (putting on the traditional fabric), marocak (spreading the coin along the way to Datuak grave), pidato alam (welcoming speech), and manigo ari (praying after the funeral procession). It contains values within, such as the leader’s majesty, datuak wisdom, and symbols of broad and clean thought. In addition, it holds sharia, educational, and social values. Osong kapali tradition is a combination of custom and religion represented in the ceremonial sequences which agree with the ideology of sarak basandi kitabullah, the Quran-based tradition</p>

<p> Learning is the most significant activity in education. Through learning activities, the goals of education are achieved. Students’ success in learning mostly depends on their mastery to learn independently and on how they manage their study. The research aims to develop learning model at Madrasah Tsanawiyah, to make the learning process triggers students to be more creative and study better. The method used in the research refers to the nature of Research and Development. The steps of the study are preliminary study, development, and product test. The study found that the development of a jurisprudential inquiry-based learning model for learning Fiqh helps students to improve their learning outcomes. The model has significantly proven effective to support students’ behavior change, thus their achievement increases</p>
