Skripsi yang berjudul Status Pernikahan Siri Yang Memakai Wali Sewaan Menurut Hukum Islam (Studi Kasus Di Nagari Simpang Utara Kecamatan Simpati) yang ditulis oleh Hamdiki Ikhsan Jean NIM 1119156. Program Studi Hukum Keluarga Islam (Ahwal Al-Syakhsiyyah) Fakultas Syari’ah Universitas Islam Negeri (UIN) Sjech M. Djamil Djambek Bukittinggi. Pernikahan siri dengan menggunakan wali sewaan merupakan fenomena kompleks dalam tinjauan hukum Islam. Meskipun sah secara agama karena memenuhi syarat-syarat rukun pernikahan seperti wali, dua saksi, ijab qabul, namun tidak tercatat secara resmi oleh negara. Hal ini menimbulkan pertanyaan tentang keabsahan dan implikasi hukum pernikahan tersebut. Dalam pandangan hukum Islam, wali adalah rukun yang harus dipenuhi dalam pernikahan, bertugas melindungi kepentingan mempelai perempuan. Penggunaan wali sewaan, yang tidak memiliki hubungan nasab dan mungkin tidak memiliki kepentingan pribadi yang sebenarnya terhadap mempelai perempuan, memunculkan keraguan tentang legitimasi pernikahan tersebut di mata hukum. Ketidaktercatatan resmi pernikahan siri dapat berdampak pada hak-hak hukum dan sosial dari semua pihak yang terlibat. Oleh karena itu, penting untuk mempertimbangkan perlunya pencatatan resmi pernikahan untuk melindungi hak-hak individu dan menjaga keadilan dalam masyarakat. Atas alasan inilah maka peneliti tertarik untuk membahas dan meneliti lebih dalam lagi mengenai status pernikahan siri yang memakai wali sewaan di Nagari Simpang Utara Kecamatan Simpati dan tinjauan hukum Islamnya. Penelitian ini adalah penelitian lapangan (field research). Dalam penelitian lapangan (field research) ini, peneliti mengumpulkan data dengan melakukan pengamatan (observasi) dan wawancara langsung ke informen, dalam hal ini pasangan pengantin yang bersangkutan, wali nagari dan peneliti akan memperoleh sumber data dari buku, jurnal, dan penelitian terdahulu terkait permasalahan yang diangkatkan. Berdasarkan Hasil penelitian menunjukkan bahwa pasangan pengantin yang menggunakan wali sewaan memiliki alasan berbeda, seperti penolakan wali yang sah untuk menikahkannya, keinginan menyembunyikan pernikahan, dan menjaga privasi. Menurut hukum Islam, wali merupakan rukun pernikahan yang harus dipenuhi. Penggunaan wali sewaan, yang tidak memiliki hubungan nasab dengan mempelai perempuan, menimbulkan pertanyaan tentang keabsahan pernikahan tersebut. Meskipun sah menurut syarat agama, tidak adanya pencatatan resmi dapat mengakibatkan konsekuensi hukum dan sosial. Penelitian ini memberikan wawasan penting mengenai praktik pernikahan siri dan implikasi hukumnya, serta menggarisbawahi pentingnya pencatatan pernikahan secara resmi untuk melindungi hak-hak semua pihak yang terliba
