Abstrak
This thesis is entitled "Balek Ritual (Mando'a) in Land Buying and Selling Transactions High Heritage Treasures in Jorong Kubang Pipik, Baso District, Agam Regency In the Sociological Perspective of Islamic Law", written by Mifthah Aulia Rahmah, NIM 1221,004, Sharia Economic Law Study Program (Muamalah) Faculty Sharia State Islamic University (UIN) Sjech M. Djamil Djambek Bukittinggi. The use of buying and selling inheritance land is high using rituals The balek(mando'a) is to be a witness that the land is owned for sale and cannot be contested by anyone. But because Due to social, economic and educational factors, land buying and selling occurs high heritage which is followed by the balek ritual (mando'a). In Minangkabau it cannot be separated from customary law or customary rules, Islamic law when viewed from the sociology of law cannot be separated from the socio-cultural influences that live around him, So ritual in the sociological conception of Islamic law has several meanings as a tradition or habit carried out by a functioning society as traditional ceremonies, celebrations, religious practices and as cultural symbols to maintain traditional values in the community's beliefs. So with the existence of sociological studies of Islamic law will strengthen the assessment regarding the good and bad of the balek (mando'a) ritual in buying and selling inheritance land high who found social facts, namely due to economic factors and education that supports the sale and purchase of high inheritance land and accompanied by the balek ritual (mando'a)This research uses types Qualitative field research. Collection technique The data is by conducting direct observations and interviews in the field, and techniques for analyzing data using analytical descriptives qualitative approach. Based on the results of research and analysis carried out It was found that firstly, it was true that buying and selling was already taking place since the ancestors of this community. This buying and selling using ijab qabul, namely in the form of siriah pinang kanagarian (administration). Second, According to sociology, Islamic law will strengthen judgments about goodness and the bad ritual of balek (mando'a) in buying and selling transactions for high inheritance land who discovered social facts, namely due to economic and educational factors which supports the sale and purchase of high inheritance land and is accompanied by there is a balek (mando'a) ritual.
